DUMPSTER RENTAL AGREEMENT
1. Parties. This agreement is between [Company name, address, phone] (“Company”) and the customer named below (“Customer”).
2. Equipment and placement. Company will deliver one [__]-yard roll-off container to [job-site address] on or about [date]. Customer chooses the placement location and confirms it can bear the weight of a loaded truck and container. Company is not responsible for damage to driveways, curbs, lawns, sprinkler lines, septic systems or underground utilities at the placement location Customer selects. Customer will keep the container accessible for pickup.
3. Rental period and extra days. The rental period is [] days from delivery. Each additional day the container remains on site is billed at $[] per day.
4. Price, included weight and overage. The rental price is $[], which includes delivery, pickup and disposal of up to [] tons. Weight is determined by the certified scale ticket from the disposal facility. Weight above the included tons is billed at $[] per ton. Containers loaded above the rim (“overfilled”) may be refused or charged a $[] fee.
5. Prohibited items. Customer will not place hazardous waste, paint, oils, fuels, solvents, batteries, tires, asbestos, medical waste, [refrigerant appliances, mattresses - list your local rules] in the container. Removal or disposal costs for prohibited items, plus a $[__] handling fee, will be charged to Customer.
6. Permits. If the container is placed on a public street or right-of-way, Customer is responsible for obtaining any required permit unless Company agrees in writing to obtain it for a fee of $[__].
7. Payment. Customer authorizes Company to charge the card on file for the rental price at booking and for overage, extra-day, overfill and prohibited-item charges after pickup. [Deposit terms.]
8. Relocation, swaps and dry runs. Customer will not move the container. If Company cannot deliver, swap or pick up because of a blocked or unsafe location, a trip fee of $[__] applies.

Clause by clause: why each one is there
- Placement and surface damage
A loaded 20-yard on a truck is very heavy; cracked driveways are the most common dispute. Have the customer choose the spot, take a placement photo at drop, and disclaim damage at the chosen location.
- Included tons + overage per ton
You pay the landfill by the ton - EREF’s 2023 US average was $56.80/ton, $84.44 in the Northeast. The scale ticket is the evidence; state the per-ton rate in writing.
- Extra days
A can sitting on site is a can not turning. A daily fee after the rental period keeps inventory moving.
- Prohibited items
Your disposal facility’s rules set this list. Tires, batteries, paint and appliances with refrigerant commonly carry surcharges or bans.
- Permits
Street placement usually needs a city right-of-way permit. Say who gets it and who pays.
- Card on file
Authorization to charge overage and extra days after pickup is the difference between billing it and chasing it.
